TERMS AND CONDITIONS OF USE – PROPINDER

These Terms and Conditions (“Terms”) govern access to and use of the Propinder website, platform, tools, and related services (collectively, the “Platform”).

By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

Baix Gaia Educa S.L. operates the Platform under the commercial brand “Propinder.”

2. PURPOSE AND NATURE OF THE PLATFORM

Propinder is an informational and aggregation platform that provides users with access to structured information related to third-party proprietary trading firms (“Prop Firms”).

The Platform may include, among other features:

  • An optional profiling survey based on user-provided preferences and constraints
  • Informational displays showing examples of Prop Firm challenges commonly selected under similar parameters
  • Listings of Prop Firms, including both affiliate and non-affiliate firms
  • A user profile area where users may view or store their submitted information

Propinder does not:

  • Offer or sell proprietary trading challenges
  • Act as a broker, dealer, financial intermediary, or agent
  • Provide financial, investment, or trading advice
  • Make recommendations, rankings, or suitability assessments
  • Guarantee acceptance, approval, success, or profitability

The Platform serves strictly informational and educational purposes.

3. NO FINANCIAL ADVICE / NO RELIANCE

All content and outputs provided through the Platform are provided for general informational purposes only.

Nothing on the Platform constitutes or should be interpreted as:

  • Financial advice
  • Investment advice
  • Trading recommendations
  • Personalized guidance
  • An offer, solicitation, or endorsement of any Prop Firm, product, or service

Users acknowledge and agree that:

  • Trading and proprietary trading challenges involve significant risk
  • Prop Firms operate independently from Propinder
  • All decisions are made solely at the user’s own discretion and risk

Users should seek independent professional advice where appropriate.

4. PROFILING SURVEY & INFORMATIONAL OUTPUTS

4.1 Nature of the Survey

The optional profiling survey is based exclusively on information voluntarily provided by the user.

The survey output:

  • Is descriptive, not prescriptive
  • Is based on aggregated patterns, generalized logic, or commonly observed selections under similar parameters
  • Does not evaluate the user
  • Does not score, rank, or optimize outcomes
  • Does not predict success, approval, or performance

Statements such as “users with similar characteristics often explore” or “commonly selected under similar constraints” are informational observations only.

4.2 No Automated Decision-Making

The Platform does not perform automated decision-making within the meaning of applicable data protection or AI regulations.

In particular:

  • Outputs have no legal, financial, or contractual effect
  • No decisions are made on behalf of users
  • Results are non-binding, optional, incomplete, and may be ignored

Users remain fully responsible for evaluating any Prop Firm independently.

4.3 No Exhaustiveness or Accuracy Guarantee

Survey outputs and listings:

  • Do not represent the full market
  • May exclude firms, challenges, or options
  • May become outdated or inaccurate due to changes made by third parties

Propinder has no obligation to monitor, update, or correct third-party information in real time.

5. PROP FIRM LISTINGS & THIRD-PARTY SERVICES

The Platform displays information relating to independent third-party Prop Firms.

Propinder:

  • Does not control Prop Firms
  • Does not verify or guarantee their rules, practices, or legality
  • Is not responsible for challenge evaluation, acceptance, rejection, payouts, or account termination

Any relationship, transaction, or dispute between a user and a Prop Firm is strictly between those parties.

6. AFFILIATE & COMMERCIAL DISCLOSURE

Propinder may maintain affiliate or commercial relationships with certain Prop Firms listed on the Platform.

This means Propinder may receive compensation if a user interacts with or purchases a service from a third party through links on the Platform.

Users acknowledge that:

  • Affiliate relationships do not constitute endorsement
  • Compensation does not imply recommendation or suitability
  • Listings may include both affiliate and non-affiliate firms
  • Visibility or presence does not imply quality, approval, or legitimacy

Users are solely responsible for conducting their own due diligence.

7. USER ACCOUNTS & PROFILES

Certain features may require users to create an account.

Users agree to:

  • Provide accurate and truthful information
  • Maintain the confidentiality of their access credentials
  • Accept responsibility for all activity under their account

Propinder reserves the right, at its sole discretion, to suspend or terminate accounts without prior notice if:

  • These Terms are violated
  • Misuse, abuse, or manipulation is detected
  • False or misleading information is provided
  • Legal or security risks arise

Termination may result in loss of access to stored information.

8. INTELLECTUAL PROPERTY

All content, structure, logic, design, software, databases, trademarks, and branding on the Platform are owned by or licensed to Baix Gaia Educa S.L.

Users are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal, non-commercial purposes only.

Unauthorized copying, scraping, reproduction, reverse engineering, or commercial use is strictly prohibited.

9. THIRD-PARTY LINKS

The Platform may contain links to third-party websites or services.

Propinder:

  • Has no control over third-party content
  • Assumes no responsibility for third-party practices
  • Does not endorse or guarantee third-party services

Users access third-party platforms at their own risk.

10. PLATFORM AVAILABILITY & MODIFICATIONS

Propinder may modify, suspend, or discontinue any aspect of the Platform at any time without notice.

The Platform is provided on an “as-is” and “as-available” basis. Continuous availability is not guaranteed.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • Propinder shall not be liable for trading losses, failed challenges, lost profits, or third-party actions
  • Propinder makes no guarantees regarding accuracy, completeness, or outcomes

Total cumulative liability, if any, shall not exceed EUR 50, regardless of the legal basis of the claim.

Some jurisdictions may not allow certain limitations; in such cases, liability is limited to the maximum extent permitted by law.

12. INDEMNIFICATION

Users agree to indemnify and hold harmless Baix Gaia Educa S.L., its affiliates, directors, employees, and partners from any claims, losses, or expenses arising from:

  • Use of the Platform
  • Violation of these Terms
  • Interactions with third-party Prop Firms

13. ELIGIBILITY & JURISDICTIONAL USE

Users must be at least 18 years old.

The Platform may not be lawful or available in all jurisdictions. Users accessing the Platform from restricted jurisdictions do so at their own risk and are responsible for compliance with local laws.

14. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of Spain.

Any disputes shall be submitted to the exclusive jurisdiction of the courts of Barcelona, Spain.
